Program Background

The Kemitraan Indonesia Australia untuk Infrastruktur (KIAT) is a facility supported by the Australian Government and implemented by Cardno. KIAT’s overarching goal is to support ‘sustainable and inclusive economic growth through improved access to infrastructure for all people’. To support this goal, KIAT works with the Government of Indonesia (GOI), Government of Australia, the private sector, Multilateral Development Banks (MDBs) and other development partners, as well as civil society to help achieve the following ‘End-of-Facility Outcomes’:

1.      Improved GOI policy and regulatory framework for infrastructure development

2.     High quality projects prepared and financed by GOI, the private sector and / or MDBs

3.     High quality infrastructure delivery, management and maintenance by GOI

The initial focus of KIAT Facility is on the following areas: Water and Sanitation; Transport; Gender, Social Inclusion and Civil Society Engagement (GESI-CSE); and Infrastructure Funding and Financing.

 

The role

KIAT is looking for Legal Expert will assist is to develop key legal documents necessary for the enabling and the operation of the Road Preservation Fund (RPF).

The main objective of this position are to draft and review regulations at the national and sub-national levels for the setup and the operation of the RPF, based on existing draft documents and regulatory briefs, and provide guidance on selected key issues.

 

This role also involves the following key activities:

The Legal Expert will perform the following tasks:

·       Review existing laws related to RPF, draft version of new regulations recently prepared by KIAT, regulations in all areas that effect RPF and latest briefings on RPF development, including academic papers.

·       Advise on the appropriateness of the existing legal instruments for operationalising RPF

·       Advise on the legal requirements for the organisational structure to manage RPF

·       Develop:

a.      Final text of Government regulation on the RPF (DPJ), based on existing draft

b.     Final text of Presidential regulation on the organisational structure of the RPF, based on existing draft

c.      Draft text for The Financial regulations on sources and mechanism of RPF

·       Provide guidance:

a.      For updating provincial regulations in selected provinces and for inclusion of new GESI-CSE clauses

b.     On legal consequences (non-compliance and enforcement administration, court of law burden, etc..) of having a fund with uniform rules and regulations (taxation sources, charges, revenue usage, etc…) across the country vs decentralised rules and regulations at provincial and district levels related to RPF

·       Coordinate with the RPF specialists

·       Liaise with KIAT representative

·       Ensure that consultations, meetings, and decision-making processes include representations of gender

·       Ensure that all key activities consider opportunities to strengthen Gender Equality and Social Inclusion (GESI) outcomes during implementation, and where relevant consider the feasibility of engaging with civil society to enhance these outcomes.

About you

Legal Expert must bring a deep understanding and/or have experience of:

Essential:

·       Degree in law from an accredited university; advanced degree preferred

·       At least 10 years of professional experience in preparing Indonesian regulations, agreements or contracts

·       Sound knowledge of Indonesia’s legal and regulatory framework

·       Excellent verbal and reporting skills in Bahasa Indonesia and the ability to communicate with a wide range of stakeholders from diverse backgrounds

·       Good verbal and reporting skills in English

 

Desirable:

·       Experience in drafting Indonesia financial regulations

·       Familiarity with international/Indonesia transport laws and regulations

·       Experience in preparing presentations on legal issues especially regarding public financial issues

·       Relevant experience in Indonesian projects

 

Remuneration

Based on KIAT established rates. Successful Indonesian nationals will be engaged under a Short Term Local Independent Contractor Agreement in IDR and will be subject to Indonesian employment regulations and tax obligations.
