Position Title: Safeguard Advisor
Program: Revitalising Informal Settlements and their Environments (RISE)
Reporting to: Project Manager (Melbourne), Build Team Leader (Makassar), RISE Country Coordinator (Makassar)
Duty Station: Makassar, Indonesia
Duration: 3 months
Required level of experience: 10+ years at senior level in Safeguards Advisor

Background:
Revitalising Informal Settlements and their Environments (RISE) is a design-research program, which aims to demonstrate that a Water Sensitive Cities (WSC) approach to water and sanitation management can improve human and ecological health in informal settlements. The program is operating in 24 informal settlements across Suva, Fiji and Makassar, Indonesia.

The WSC interventions of the RISE project operate on varying scales – household, neighbourhood, and precinct. They include built elements, such as sanitation and drainage improvements, rainwater harvesting facilities and green infrastructure (constructed wetlands). The success of the RISE interventions will be measured by the health and well-being of residents – particularly children under five years of age – and the ecological diversity of the surrounding environment.

The Role
The RISE program is currently seeking an experienced and responsible Safeguards Advisor to oversee and be involved in the process of securing resident land in Makassar, Indonesia. A person who supports the work in developing the implementation of appropriate strategies to ensure timely securing of resident land for infrastructure.

The successful candidate must be passionate about working with communities and have a good understanding of regulation related resident land and implementing processes in local government.

The Safeguard Advisor, together with the Build Team Leader, will undertake negotiations with City officials and also work with the RISE team in Makassar and Melbourne. The role requires a confident communicator who can guide discussions and negotiations to find a suitable mode of implementation to support the delivery of community infrastructure – as agreed with communities during the co-design process.

During the project implementation, the safeguard Advisor will provide social safeguard oversight and capacity building to project implementers to ensure that project activities are in line with good social management practices. The Advisor will assist in the review and preparation of necessary documents, such as Environment and Social Impact Assessment and Management Plan (ESIA/MP), Standard Operating Procedures (SOPs) and Monitoring and Evaluation tools in consultation with stakeholders. The Advisor will also provide ongoing support and guidance to staff working on social safeguards.

Key responsibilities:

1. Coordinating with key stakeholders: BAPPEDA, Land Agency, Housing and Settlement Agency, Development Inspectorate regarding procedures for community land use and agree appropriate land use instruments (e.g. izin pakai, izin membangun, hibah tanah) for community land use across the 6 sites in the RISE Project.
2. Facilitate discussions between the Makassar City Government and two housing development companies adjacent to the location regarding land grant, land use for public facilities (Fasum), land use for social facilities (Fasos) for RISE infrastructure.
3. Develop an appropriate implementation strategy, monitoring and reporting, and ensure successful community land use for the infrastructure in a timely manner, in line with the community expectation.
4. Coordinating with the kelurahan government, RW and RT heads regarding socialization, mechanisms and procedures for the appropriate land use instruments/agreements for community land use for RISE infrastructure (izin pakai)
5. Collaborating with Build Team Makassar and Community Field Worker regarding socialization of community land use through mechanism of izin pakai.
6. Prepare legal documents for community land used for RISE infrastructure (e.g. izin pakai)
7. Review existing Safeguards documents and draft Land Use Agreements, through izin pakai provide feedback and work with the Melbourne and Makassar RISE teams to ensure compliance with both Indonesian law as well as donor requirements (DFAT/KIAT).
8. Ensure that all land agreements/instruments are in accordance with legal procedure and do not cause conflict.

Detailed duties:
• Finding solutions that align with key stakeholders needs and enable land provision the infrastructure in Makassar, in line with community expectations;
• Continue discussion with developers and the City of Makassar to facilitate the land donation approval process from developers for RISE infrastructure;
• Engaging in community gathering; provide written report on finding both compliments and complaints; and proven recommendation and follow-up solution;
• Coordinating with Makassar Build Team, Build Team Leader and Community Field Workers;
• Together with the Build Team Makassar documenting written files, letters that are important;
• Building a good network and communication with local government in city and sub district level where RISE works; in line to get support in technical and administration matters of resident land.
• Preparation of reports including the monthly progress reports and other reports as required by Monash/donors;

Technical Skills:
• Knowledge and experience in handling resident land instrument in accordance with applicable laws and regulation.
• Good relationship with the city, sub-district and village government, especially for land acquisition
• Knowledge and experience with, the Indonesian regulation, procedure, rules, and land policy
• Sound knowledge of land issues in Indonesia
• Excellent written and verbal communication skills;
• Proficient in written and spoken English
• Demonstrates openness to change and ability to manage complexities.
• Consistently approaches work with energy and a positive, constructive attitude.

Required qualifications and experience:
• Minimum Bachelor degree in law or related discipline
• Strong ability to work with partners using effective interpersonal and communication skills and to respectfully interact with people from diverse cultural backgrounds.
• At least 10 years of experience with:
• Implementation of community development / safeguard projects in Indonesia,
• Safeguard mechanisms for infrastructure projects in Indonesia;
• Monitoring, reporting and associated processes and procedures at central and city government levels for financing community development projects.
